We are registered in the United Kingdom under company number 12984238 and have our registered offices at Mailboxes 73 Holloway Road, N7 8JZ 1.Please read the below terms and conditions (the TERMS) carefully to ensure a smooth and enjoyable experienced for you and your guests. By accepting the contents within you enter into an agreement with us. These TERMS outline the responsibilities, expectations, and policies related to our services, including booking, payments, cancellations and safety guidelines. 2. If you do not accept these TERMS please do not access our services 3. We may update these TERMS at any time. Clients should routinely check for updates before continued use of this service. BOOKINGS 4. All Private and Corporate clients should complete a booking form. An invoice will be generated and sent with a 50% retainer fee to secure the booking. Please note that without a completed form and retainer fee the event date cannot be confirmed. The retainer amount will be deducted from the total cost of the service. The remainder of the fee should be paid as per stipulations on event invoice. STATUTORY LATE CHARGES ARE APPLICABLE for delayed payments. The unplanned overtime rate is £45 per half hour or part of. To be agreed to and paid before overtime starts. The artist will not be liable for non-attendance due to incorrect or incomplete booking details being provided. CANCELLATION POLICY 5. The artist must be notified of cancellations, in writing, as soon as possible. For cancellations less than two weeks away from the scheduled date – See below for the cancellation fees. In the case a refund is due, a BACS payment for the outstanding balance will be made within 21 days. Cancellation by artist: In the rare instance that an artist must cancel a service, the WE will contact the client at the earliest possibility. A replacement artist will always be scheduled first. However, if one is not available the client will be informed. The client will be offered a rescheduled date, credit note or full refund. Applied Fees: 1. >14 days’ notice = Full refund less £50 reservation charge. Date can be rescheduled for no extra charge. 2. 13 days to 5 day notice = Full refund less £70 reservation charge. Dates can be rescheduled for no extra charge 3. <5 days notice = client will be liable for full payment. FORCE MAJEURE 6. Cancellation due to unforeseen circumstances: If your event is cancelled due to a circumstance outside of your control such as forced closure due to a global pandemic, inclement weather, illness or accident. NYGlorious Face Arts cannot be held liable, and the cancellation policy and fees are applied. SET UP 7. The artist will arrive approx. 10-20mins prior to agreed time. Corporate jobs arrival times can be up to 60mins in advance if required. Any additional set up time required will be factored into the client service fee. Please arrange two adult sized chairs and medium table to be available to use and access to tap water. WE can provide furniture upon request and at cost to the client. If the event is being held outdoors clients agree to provide cover. Shelter protects the artist from either hot or wet weather. NYGLORIOUS FACE ARTS LTD can provide cover for events over 3 hours. At request and additional hire costs 3x3m (£50) or 6x3m (£75) commercial grade fully branded tents. Please ensure adequate space for this style of set up. If the event is indoors, please ensure adequate lighting. If Airbrush services are booked please ensure adequate ventilation. The client will be responsible to identify /provide parking at venue as close to the entrance of the building as possible, since the artist will have to carry heavy equipment in. Artists are to have a 15min break every four hours. Client must aid in watching equipment whilst loading/unloading and during breaks. END & PACK DOWN 8. The artist will assess the queue and may close the queue to new participants 20 minutes ahead of time. This ensures artist do not go over their allotted booking session. If additional work is requested and agreed, then payment will need to be made immediately at noted overtime costs. Artists should not be pressured to stay and paint beyond the booking time unless agreed and paid for. If the artist does stay without payment, the overage will be due to NYGLORIOUS FACE ARTS LTD, within 24 hours. STATUTORY LATE PAYMENT FEES WILL BE APPLIED IF THIS IS NOT ADHERED TO. The client will be expected to pay the full service fee even if the client uses the artist for less time than booked for. DAMAGE AND INCIDENTALS 9. In the event that any equipment, materials or supplies belonging to NYGLORIOUS FACE ARTS LTD are damaged, by the client whether accidentally or intentionally by their guests/ pets or is lost or stolen during the event, the client agrees to cover the cost of repairs or replacements. This includes, but is not limited to, brushes, paints, chairs, tables and any other property used to deliver a service. If the face paint artist equipment is moved without permission, the client may be held financially responsible for any necessary repairs or replacement costs. Any additional incidentals required to facilitate the service, such as travel, accommodation, or bespoke and/or special equipment will be charged to the client. The artist will use reasonable care but is not responsible for damage to property, personal belongings, and or preventable accidents that occur during the delivery of any booked services. CLIENT BEHAVIOUR AND CONDUCT 10. The Artist is present only as a painter and will not supervise children. The behaviour and safety of the children is the responsibility of the client/parent/carer/host. It is client/hosts responsibility to manage and vet the face painting queue. Please direct children to the artist if there is space and refrain the children from crowding the artist workspace as this can cause distractions or unsafe conditions for both the artists and others in the area. Line management attendees can be provided on request (at cost £25 per hour) Clients are responsible for providing a safe working environment /conditions for any employee and/or artists who works for NYGLORIOUS FACE ARTS LTD free from aggression and perceived physical or emotional danger. If there is an interruption of service from a child or guest, or anyone acts in a way that prevents the artist from performing the service effectively NYGLORIOUS FACE ARTS LTD reserves the right to stop service until proper supervision or intervened correction is offered. If artists deem any aspect of the booking to be unsafe, they have a right to leave. In this instance the cost of the booking will not be refunded. NYGLORIOUS FACE ARTS LTD will not tolerate any abuse or intimidation. Clients who do not adhered will be banned from using our services in the future. HEALTH & SAFETY 11. Hosts, left in charge of any children without their parent/carer, are responsible for obtaining permission from the parent for that child to participate. A prepared permission form is available by email on request. You will also be responsible for ensuring only participating guests approach the artist for a design. HYGIENE IS PARAMOUNT to avoid cross infection, please ensure participant’s mouths and noses are wiped and face is CLEAN and DRY before being seated for painting. Read below for reasons why people should not participate. · Anyone who appears to be suffering from Chicken Pox, Measles, Rubella, Impetigo, Scabies, Cold Sores, · Conjunctivitis or who suffer from Eczema with open cuts and sores. · A guest who is generally unwell or suffering from any contagious respiratory illness. · Children who are reluctant, too wriggly or asleep! · Anyone who has sensitive skin or allergies. {However with permission of a responsible guardian, a skin patch test can be carried out on the inside of the arm on parent/carer’s request and left for approximately 60 minutes. If there is no reaction, they can be painted on their face} · Children less than three years of age. *This is guided by manufacturer’s instructions due to skin sensitivities – under 3s can be offered an arm painting on agreement with parent/guardians. The artist reserves the right to refuse · Anyone that is or seems to fall in any of the categories mentioned above. · Anyone that is abusive, violent or intoxicated. · Anything that could be considered as offensive. · Inappropriate parts of the body. NYGLORIOUS FACE ARTS RESPONSIBILITIES 12. Our artists · are fully insured with £2-5m Public Liability dependant on scale of the event. Certification available on request · will clean the workstation, back to the original manner you provided it. · will adhere to industry health and safety practices, including one sponge per face to minimize cross infection. · Brushes will be washed, and water changed frequently during the event. All equipment is washed and sanitised thoroughly after an event. Only industry compliant and cosmetic grade products will be used. PAINT PRODUCT INGREDIENT MSDS sheets available on request via email. · Artists have DBS CHECKS and have undertaken a BARBICDE infection control course. PROMOTIONAL MATERIAL 13. Artists reserves the right to display and distribute promotional material during the event. Artist may bring products to sell appropriate public facing events. If photos are taken by the artist, they will be obtained with express permission from participants and will be used solely for the purpose of promoting the business via social media and print.
